1. Background

1.1 This silent auction (the “Auction”) is conducted in connection with the Seamaster T2 Diamond 2019 Malaysia (the “Event”) and shall be governed by the following terms and conditions (the “Terms”). By placing a bid in the Auction, bidders agree to be bound by these Terms.

1.2 The organizer of this Auction is T2 APL PTE LTD (“T2APL”).

1.3 This Auction is open online and also to all attendees at the Seamaster T2 Diamond 2019 Malaysia at FS5 Pinewood Iskandar Malaysia Studios (“Event Venue”), except for employees of T2 APL involved in the administration of the Auction.

1.4 All proceeds of this Auction will be donated to the charitable program operated by Care Haven (“Beneficiary”), a charitable trust to enable donors to contribute in support of underprivileged children to provide care and housing for less fortunate children in Johor Bahru, Malaysia.

1.5 For the avoidance of doubt, T2 APL PTE LTD is not a sponsor of this auction and is not liable for its marketing or execution.

2. How to Bid

2.1 To submit a bid for the collectible watches (a “Watch”), signed plaque (a “Plaque” and a signed bat (a “Bat”) bidders must complete the official auction slip provided online and may also bid and place it in the collection box located in the Event Venue (a “Bid”). Bids may be submitted online from 1st to 21st July 2019 and/or at the Event Venue from 18th to 21st July 2019 (the “Bidding Period”). Bidders must complete all sections of the Bid slip and T2APL reserves the right to reject any incomplete or illegible slips.

2. 2 A Bid, once submitted, will constitute a binding offer to purchase which is capable of acceptance by
T2APL. Each Watch, Plaque and Bat will be awarded to the highest bidder for that Watch, Plaque and Bat subject to payment by the successful bidder of their Bid amount. Bids shall be deemed inclusive of GST and/or any other applicable tax.

2.3 Bidders may bid for one or more Watches, Plaques, Bat and each separate Bid shall constitute a separate offer to purchase. In the event that a single bidder submits the highest Bid for more than one Plaque, they
shall be entitled (but not obliged) to elect to receive and pay for one such Watch, Plaque and Bat only, in which event the remaining forfeited Watches, Plaques and Bats shall each be awarded to the respective second highest bidders.

2.4 Once an individual’s Bid is submitted, it is considered a final submission and may not be modified,
edited or withdrawn.

3. Announcement of successful bidders

3. 1 Following the conclusion of the Bidding Period, T2APL shall contact the highest bidder for each of the Watches, Plaque and Bat via the email address included on their Bid slip and shall announce the successful bidders on the social media channels and/or email to the Event mailing list on the 28th July 2019. By submitting a Bid, bidders consent to their name being published via any such
channels and platforms.

3.2. In the event that equal highest Bids are submitted by more than one bidder for the same Watch, Plaque, Bat, T2APL shall be entitled to conduct a ‘tie-breaker’ to select the successful Bidder, the nature of which
shall be determined by T2 APL at its discretion.
